These terms and conditions are in place to ensure complete transparency of the work undertaken by Chloe Rose Photography, and to ensure there are no misunderstandings between photographer and client as regards the products or services offered. All bookings are accepted with an understanding that the terms and conditions below are agreed with. Where the terms state ‘photographer’ they are referring to Chloe Stirling.
1. Preparing for your session
The Client shall endeavour to not give their baby a full feeding for two hours before the session and shall endeavour to keep their baby awake for one or more hours before the session. The baby shall be fed immediately at the beginning of the session or just prior to arrival. The photographer will try to accommodate requests for siblings to be included at a newborn photoshoot normally at either the start or the end of the session. At other times during a newborn session it is advisable where possible that siblings are kept away from the area being used to photograph. Ideally the photographer requests no other children (aside from sibling photographs), or more than 2 adults aside from photographer in the same room where the session is taking place. This is important for health and safety reasons and to assist smooth running of the session.
2. Retainer & payment
A deposit of a percentage of the session fee may be required upon booking and is non refundable if the photoshoot is cancelled by the client, or client fails to attend. However the client may reschedule up to 48hrs before the session should unforeseen circumstances arise such as illness or accident. The remaining payment is due no later than the time of the photoshoot.
Should the photographer not be available for the session due to unforeseen circumstances (such as illness or accident), the photoshoot will be rescheduled to a mutually convenient time. If that is not convenient then a full refund of any money paid shall be given to the client and no further liability will be incurred by Chloe Rose Photography.
All sessions are undertaken to the best of the photographer’s abilities and all efforts will be made to fulfil the requirements of the client where possible. However as babies and young children are naturally unpredictable there is no guarantee on any desired outcome. Chloe Rose Photography cannot be held responsible for photographs that could not be taken due to time constraints or other unforeseen circumstances such as equipment failure. Additional time can be requested at the time of the booking or during the shoot to attempt to fulfil any extra photographs, subject to the availability of the photographer. If the photographer feels that the body of work is not sufficient within the allotted session then, at the discretion of the photographer, another photoshoot will be rescheduled free of charge or discounts may apply.
5. Artistic rights
Prices may be subject to change. All orders are placed only when full payment has been received and on the understanding that products ordered are non-refundable. If you are unhappy with any products from Chloe Rose Photography every effort will be made to rectify the issue, but please be aware that any changes may be subject to a fee unless the product itself is defective. Please notify Chloe Rose Photography of any issues within 14 days of receiving a product. Client may be asked to approve a proof for a custom product eg collage, Chloe Rose Photography is not liable for any changes once client has given approval and the item has been processed. Digital image files are supplied to the client as jpeg files, images are not available in RAW format. The Client(s) hereby agrees that he/she fully understands that there are no full refunds or exchanges on purchases after the session is completed due to the custom nature of newborn portrait photography.
6. Photographic materials
Editing of the photographs is at discretion of the photographer, any additional editing requests will only be taken out if the photographer is happy with the request and an additional fee may apply. Please be aware that when requesting photographs in different dimensions to the originals some cropping of the images may be required and this will be undertaken at the discretion of the photographer.
7. Copyright & Reproductions
All photographs remain the property of Chloe Rose Photography and all copyright is retained by Chloe Rose Photography unless otherwise stated. Copying or editing of any digital image files or printed material is not permitted unless previously agreed in writing and client has paid in full. Copying from the website is forbidden. In order to display recent work Chloe Rose Photography retains the right to use any photographs taken for promotional material, digital (including photographer’s websites) or printed. Displaying work is integral to photographer’s business and a selection of images may be used for this purpose without further permission sought unless the client has informed otherwise. Photographs will not be sold to a third party without prior written permission from the client.
8. Client usage
Please note that all computer monitors are calibrated differently and the final print may differ slightly in colour or brightness from what you see on the monitor. Chloe Rose Photography takes no responsibility for prints created on a low quality printer where clients are creating their own prints from purchased digital images, and it is recommended that they use a reputable printing service.
9. Online sharing
A viewing and ordering session / online gallery will normally take place within 1 month of the photoshoot date. Photographs will be kept on file for a minimum of 6 months from the date of the photoshoot after which time they may no longer be available for purchase or selection. Additional orders placed should normally be delivered to client within 1 month from date of payment. The Photographer will post preferred shot(s) from the session on the Facebook fan page during the editing process and encourages the client(s) to tag himself/herself and share with friends and family. The Client may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. Client shall not copy, download, screen shot or capture the photographs in any other fashion.
9. Liability & indemnification
If the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to, camera and processing, or photographic materials are lost or damaged without fault of the Photographer, liability shall be limited. The Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release the photographer from any claims against their person or their business. The Client(s) will waive, disclaim and release Chloe Rose Photography and it’s respective owners, members, employees, agents, volunteers and representatives from any and all actions, claims or demands against Chloe Rose Photography that they may have now or in the future, whether known or unknown. Parties, including without limitation those related to injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.
